The female manager fell to her death on the day of marriage
"Mom, I'm married, and I'm very happy now!" At 1:30 p.m. on November 30, Dai Xiaojun (a pseudonym) called to tell her mother the good news. She had just gone to the Civil Affairs Bureau to register her marriage with her boyfriend.
"Come back tonight and let's celebrate." Her mother was very excited and told her daughter to come back for dinner in the evening.
However, the phone call became the last conversation between the mother and daughter. Dai Xiaojun fell to his death from a building that afternoon at his workplace, Agricultural Bank of China Shanghai Zhabei Sub-branch (hereinafter referred to as "Agricultural Bank of China Shanghai Zhabei Sub-branch").
Fall to death!
At around 6 p.m. on Nov. 30, Dai Xiaojun's mother received a call from the police at the police station. Before she could react, the other end of the phone said "something happened."
At around 4 PM that day, Dai Xiaojun fell from the 12th floor window of the Shanghai Zhabei Sub-branch of Agricultural Bank of China to the 4th floor platform. Although 120 ambulance personnel had tried their best to rescue him at that time, the electrocardiogram showed no signs of life.
"I saw a woman lying on the ground, wearing navy blue overalls and jeans. The air conditioning ducts on the platform were smashed flat," said Mr. Kong, an eyewitness who led the police to the scene.
On Dec. 14, a reporter from The Paper also found Master Zhao, a security guard near the building where the incident occurred. According to his recollection, around 4:15 p.m. on Nov. 30, he saw something fall from the upper-floor window of the building and onto the air-conditioned platform on the fourth floor of a nearby hotel. He thought it was a piece of clothing, while another security guard next to him, Master Zhou, said: "That's a person!" Just as they were about to go to find out, someone ran out of a hotel and said someone had fallen.
After receiving the call from the police, Dai Xiaojun's mother was unable to go because of her disability. Dai Xiaojun's uncle, Mr. Hong, and her husband, Mr. Lu, who received the certificate for less than a day, rushed to the scene of the accident. They saw a large pool of blood at the scene of the accident. After the police investigation, the cause of death was determined to be a high-altitude fall, and homicide was ruled out.
Dai Xiaojun, a 30-year-old deputy general manager of the corporate finance department of the Shanghai Zhabei Sub-branch of Agricultural Bank of China, has worked at the unit since she graduated from college in 2008. The unit rated her as "very excellent." Mr. Hong said she had studied hard and had ideas since childhood.
"From the position of the fall, it can be seen that Dai Xiaojun fell from the conference room window on the 12th floor of the unit." Mr. Hong approached the window, and there was a sofa for employees to rest by the window, and there was a shoe of Dai Xiaojun by the sofa. He tried to open the window, but found that the window was very tight. "I pushed it open with a lot of force."
From this, Mr. Hong speculated that at around 4 PM on November 30, Dai Xiaojun came to the conference room and wanted to open the window to breathe, but because he was relatively thin, he couldn't open the window. He found that there was a sofa by the window, so he took off a shoe and stood on the sofa to push the window hard. When the window was pushed open, he accidentally fell down due to inertia, and there was no protective fence outside the window.
Suicide?
On December 13, surging news reporters came to the Shanghai branch of Agricultural Bank of China located in Lujiazui area. Wang, the relevant person in charge of the Shanghai Zhabei Branch of Agricultural Bank of China to which Dai Xiaojun belongs, revealed that the incident took place in Chang'an Building on Tianmu West Road. No one in the unit noticed the incident until the people in the opposite building found out and called the police.
"The room where Dai Xiaojun's accident happened is located in the northwest corner of the 12th floor. It is a conference room. The conference room is divided into two, and the middle is separated by a screen. To the east is for the club, with a round table; to the west is the'Love Home 'for employees to rest, with three massage chairs and a small refrigerator." Wang said that around 4 p.m. that day, two of Dai Xiaojun's friends came to the bank to find her and said, "She is not in a good mood. She is not at ease. I can't answer her cell phone and can't find her." It didn't take long for the news to come.
Later, the bank retrieved the monitoring of the corridor of the office area and found that Dai Xiaojun walked into the conference room alone. "Usually the door of the conference room is open, but she locked the door after entering." Wang said that because the conference room was not installed with monitoring, it was impossible to know the situation of Dai Xiaojun falling from the building.
"When we entered the meeting room, we found that one of her shoes was indoors. It was a strapped shoe, the massage chair was open, the door of the small refrigerator was broken, and the screen fell to the ground." Wang said that when the meeting was held at 2 pm that day, the layout of the meeting room was still normal, so he speculated that "she must have been in a very painful mood at that time."
The surging news reporter learned from the bank that Dai Xiaojun's family is not good. His father was laid off in 1996, and his mother has a leg disability and retired early. A year ago, his father was diagnosed with cancer and passed away on October 29 after more than a year of rescue treatment.
Wang said that Dai Xiaojun also used a lot of money for her father's treatment, and the family was also difficult; after checking Dai Xiaojun's personal account, it was found that the current deposit in her card was only 10,000 yuan, so the unit also gave her funeral a green channel and took care of a lot. "Is it possible that the economy also caused part of her pressure?"
On November 30, after his wife, Dai Xiaojun, fell to her death, Mr. Lu posted a photo of the two receiving their marriage license to Moments. Mr. Lu's husband, Mr. Lu, did not agree with such claims. Less than a day after the marriage, his wife died suddenly. He still cannot accept such a blow.
"She is a very strong person, and it is impossible for her to commit suicide." Mr. Lu said that his wife was mentally prepared for the death of his father-in-law, because it has been delayed for a year, and she will not be sad to the point of suicide. "Her father's medical expenses can be reimbursed for a large part, and she herself has achieved the position of department manager of the bank with hard work. Her income is also good, and there is no problem of financial pressure."
Mr. Lu recalled that on the morning of November 30, the two happily went to get their marriage license, and at lunch they were still planning what to do in the next few days.
"We made an appointment to see my parents on the weekend, to see the hotel where the wedding was held, and to visit the wedding fair. There are many things to do, and we have even made plans for the wedding next year, November 12th." Mr. Lu said, silent, accompanied by a deep sigh.
Ms. Zhang, her best friend, also said that on the eve of the accident, Dai Xiaojun also talked to her about his wedding, imagining what the wedding would be like. "She is a very strong person. Although her father's death has a certain impact on her, she will never have suicidal tendencies. She also has a mother and a newly married husband. Life is moving in a good direction. How can she be willing to give up?"
However, Dai Xiaojun's friend Demi had another theory.
Demi was one of the friends who went to the bank to look for Dai Xiaojun on November 30. She told The Paper that she really felt that Dai Xiaojun was in a bad mental state on the day of the incident and was worried that something would happen to her.
"After she got the certificate in the morning, she started talking abnormally. She kept saying that she was at a loss, didn't know what to do, and her mind was messed up." Demi said that she and another friend rushed to the bank at 4 pm that day to talk to Dai Xiaojun, but they couldn't find anyone after walking around. They didn't reply to phone calls and text messages, so they could only wait for her in her seat. "Around 5 o'clock, the police came."
"Her father had said before he died that he wanted to see her get married, and she hesitated at that time, so that her father did not wait for his lifetime, and she blamed herself. Later, her mother's physical and mental state was not good, and she was afraid that she would also disappoint her mother. Finally, she gave in and went to get a marriage license just a month after her father passed away." Demi said that the days before Dai Xiaojun's accident were very stressful. On the one hand, her father had just passed away, and on the other hand, her family urged her to get married quickly. She was not ready.
Demi said she was worried that something would happen to her, but it still happened.
Work injury?
Mr. Hong said that on the day of Dai Xiaojun's death, the person in charge of the bank made a statement to him: try to report Dai Xiaojun's work-related injuries, or try to rely on it. However, after Dai Xiaojun's body was cremated on December 4, he mentioned the work-related injuries to the person in charge of the bank, and the person in charge of the bank did not give a clear answer.
On December 9, the head of the bank contacted Dai Xiaojun's family to negotiate at the unit. Dai Xiaojun's family believed that Dai Xiaojun accidentally fell from a building and died during working hours and in the workplace, which should be a work-related injury. "The bank said that this was a personal act, and that she (Dai Xiaojun) entered the conference room without permission and pulled the window without permission. It is not the responsibility of the bank and does not belong to the category of work-related injuries," Mr. Hong said.
He revealed that the bank hinted that their Dai Xiaojun's high fall was suicide, and they were only willing to bear about 80,000 yuan in compensation such as pensions, death subsidies, and poverty subsidies. "Suicide requires evidence, and she did not leave a will. She just got married happily in the morning, and there is no reason to commit suicide."
According to Mr. Hong, he asked several times whether it was a work-related injury, and the bank avoided the question. "We are not talking about money now, we want an explanation and justice for us. How my niece died in the workplace during working hours needs to be explained to us."
Dai Xiaojun, the relevant person in charge of the Shanghai Zhabei Sub-branch of Agricultural Bank of China, believes that various indications suggest that Dai Xiaojun's high-altitude fall cannot be counted as a work-related injury, so he cannot apply to the social security institution.
"Although Dai Xiaojun's death was during working hours and work place, we did not find that what we did in the conference room was work-related and could not be counted as a work-related injury. To apply for a work-related injury, our unit needs to provide materials to knock the official seal. If we fabricate the facts, we are committing a crime." Wang said that the total amount that the bank can pay to Dai Xiaojun's family includes union subsidies, funeral expenses, and unpaid bonuses, totaling nearly 100,000 yuan.
Article 14 of the "Regulations on Work Injury Insurance" stipulates that: During working hours and in the workplace, if an accident is injured due to work reasons, it shall be recognized as a work-related injury. In this emergency, from the objective conditions, Dai Xiaojun did die during working hours and in the workplace, but there was a disagreement between the employer and the family as to whether he suffered an accident injury due to work reasons.
In this regard, lawyer Lu Jingbo, director of the Labor Law Committee of the Shanghai Law Association and chief partner of Shanghai Jiangjiao Law Firm, said that injuries that occur during working hours and in the workplace are in principle recognized as work-related injuries; if the enterprise denies that it is a work-related injury, then the enterprise is obliged to provide evidence.
Lawyer Lu Yin, director of the labor law committee of the Shanghai Lawyers Association and chief partner of Shanghai Blue and White Law Firm, echoed the same sentiment, "unless the employer can prove that you are not working, such as she skipped work or went out to do personal affairs." Lu Yin also said that work-related injuries are no-fault liability, and even if the company is not at fault in the accident, the company should recognize the injury suffered by the employee as a work-related injury.
Lu Jingbo also revealed that some companies often shirk to avoid identifying employees' work-related injuries, mainly because of their interests. Although employees who die due to work-related injuries are mainly compensated by social security institutions for large amounts such as death grants and funeral expenses, which on the surface do not have a direct financial relationship with the company. However, with such work-related injury records, the proportion of industrial and commercial insurance premiums paid by enterprises to social security institutions will often increase in the second year, so companies are unwilling to have such records.
Zhou Jiangfeng, a lawyer at Shanghai Jiang Triangle Law Firm, revealed that, in fact, if the employer has been unwilling to recognize the employee's casualty accident as an accident, the employee (if the employee dies, the employee's immediate family) can directly apply to the local social security institution, and the local social security institution will make a conclusion on whether to identify the work injury.
