Lin was doing business in Shanghai. In 2011, he opened a current account at a bank in Hangzhou, deposited 13.50 million yuan, and then changed the account password. About a year later, Lin went to the bank to check the balance and found that only 158 yuan was left on the card.
No matter how rich he is, more than 10 million yuan is not a small amount. Lin, who was scared into a cold sweat, immediately called the police.
So, who has the ability to move the money in the bank account? How did it do it? After investigation, the police found that there are other secrets in this case.
Yesterday, the Shaoxing Intermediate Court heard the huge fraud case.
  Seduced by high interest rates
He deposited 13.50 million yuan in the bank
One of the defendants, Lu, is 57 years old and a native of Longyou, Quzhou. From the outside, he looks like a big boss, managing four large companies, whose business involves finance, engineering, trade, papermaking and other industries, and is known as "tens of millions of yuan in and out every day."
In March 2011, because Lu had a project in Jiande and needed a lot of capital turnover, he found Qian, the boss of a financial investment company in Suzhou. Qian was mainly a financial intermediary, and Lu hoped that Qian could help find a large amount of money and promised to pay high interest.
Soon, Qian contacted the victim Lin through his own company's employees.
Lin was told that as long as he opened an account at the bank and did not check the balance, transfer money, withdraw cash, or open electronic online banking within the specified period, he could receive a high interest rate of 20% to 24% per annum.
The money is in the bank anyway, and it seems that there is no risk. Lin was moved. On April 27, 2011, he opened a current account in a bank in Hangzhou and transferred 13.50 million yuan the next day.
Qian used the excuse that the bank needed to confirm the information internally, and asked for Lin's ID number, account number and initial account password.
To be on the safe side, Lin deposited the money and modified the initial secret, thinking that it would be safe to rest easy. Sure enough, in the following year, Lin received two interest payments totaling more than 1 million yuan.
In 2012, Lin went to the bank to check the balance and was shocked to find that there was only 158 yuan left in the account.
  Huge deposits disappeared
There are bank employees as the mole
Where did 13.50 million go? Since it was deposited in the bank and changed the bank password in time, how could it be transferred away? Who made the case in what way?
The matter had to start from the day Lin opened the account. After Qian got Lin's bank card and ID information, he immediately informed Lu. Lu had already agreed with Cheng (who had been sentenced), an employee of the bank's Shangyu branch, that the two soon opened online banking for the account, and Lu's employee falsely claimed the U shield.
In this way, Lin's account was "opened the back door" without his knowledge. Although he changed the account password, it did not affect the normal use of online banking, and the money in the account could still be transferred through online banking at any time.
The indictment alleges that Lu, Qian and others transferred Lin's 13.50 million yuan through the above methods, excluding the interest paid 1.269 million yuan, and actually defrauded RMB 12.231 million yuan. Most of the funds defrauded were used by Lu to repay debts and pay high interest on several other loans.
In fact, this is not the first time that Lu and others have used this method to defraud. Before this, Lu, together with Qian and others, defrauded about 778 million yuan in Jiangsu and returned about 447 million yuan in the form of principal and interest, which actually defrauded about 330 million yuan.
"Big Boss" demolishes the east wall to make up for the west wall
The capital chain is broken, it is difficult to make up for the deficit, and it is finally caught
In addition to fraud, another crime Lu was charged with is the crime of altering financial tickets. As early as 2009, he and Zhong (convicted), the branch president of Shangyu Bank, colluded to obtain 80 million yuan in the account of the victim Mr. Zhu by altering the passbook and replacing the original passbook of the household owner. Afterwards, Zhong took advantage of his position and illegally transferred the 80 million yuan to Lu's personal account and his company account, which was used by Lu, and the money was not returned to the case.
In court, Mr. Lu argued that he was raising money for his business only through "bank operations" to convert the money to his own use and then return it through the bank. "I'm just raising money in disguise, and even if it's improper, it's just illegal, not illegal."
Prosecutors said that although Lu was in charge of many companies, his financial situation was very chaotic. He ripped off the east wall to make up for the west wall, and used the high interest as bait to pay off the previous deficit. His behavior has constituted the crime of fraud.
The court did not pronounce the verdict in court yesterday.
