The Office of the National Narcotics Control Commission issued a notice reminding relevant enterprises and individuals to be cautious in selling toxic substances
In order to strengthen the control of narcotic drugs, psychotropic substances, and drug-producing substances in accordance with the law, the Office of the National Narcotics Control Commission issued the "Notice of the Office of the National Narcotics Control Commission" to the whole society on November 16.
The "Notice" consists of 12 articles, summarizing the "Criminal Law of the People's Republic of China", "Drug Control Law of the People's Republic of China", "Customs Law of the People's Republic of China", "Regulations on the Administration of Import and Export of Precursor Chemicals" and other laws and regulations on the control of narcotic drugs and psychotropic drugs and toxic substances, as well as the relevant provisions for postal services, express delivery enterprises, logistics enterprises and other units and individuals on the prevention of illegal crimes of narcotic drugs and psychotropic drugs and toxic substances, in order to remind relevant enterprises and the general public to abide by the relevant laws and regulations of the state when engaging in business activities, to prevent the production and trafficking of narcotic drugs and psychotropic drugs and toxic substances, and to prevent the sale of non-listed chemicals and related equipment, by overseas law enforcement agencies "long arm jurisdiction" "fishing law enforcement" risk, safeguard the legitimate rights and
Notice of the Office of the National Narcotics Control Commission
In order to strengthen the control of narcotic drugs, psychotropic drugs and drug-producing substances according to law, protect the legitimate rights and interests of enterprises and citizens in our country, and remind relevant enterprises and the general public to abide by the relevant laws and regulations of the state when engaging in business activities, the relevant matters are hereby notified as follows:
1. According to Article 350 of the Criminal Law of the People's Republic of China, it is strictly prohibited for any organization or individual to illegally produce, trade, or transport acetic anhydride, ether, trichloromethane, or other raw materials and ingredients used in the manufacture of drugs, or to bring the above items into or out of the country. It is strictly prohibited for any organization or individual to produce, trade, or transport the items specified in the preceding paragraph for others knowing that they are manufacturing drugs.
2. According to the relevant provisions of the Criminal Law of the People's Republic of China, anyone who knowingly uses certain non-controlled chemicals and equipment to illegally manufacture narcotic drugs or psychotropic substances but still produces, sells, transports or imports or exports non-controlled chemicals and equipment for them shall be punished as an accomplice in the crime of manufacturing drugs.
3. According to Article 21 of the Drug Control Law of the People's Republic of China, any organization or individual is strictly prohibited from illegally producing, trading, transporting, storing, providing, possessing, or using narcotic drugs, psychotropic substances, and precursor chemicals.
4. According to the relevant provisions of the Customs Law of the People's Republic of China, transporting, carrying, or mailing goods or articles that are prohibited or restricted from entering or leaving the country by the state, or goods or articles that should pay taxes according to law, is a smuggling act, and if it constitutes a crime, criminal responsibility shall be investigated according to law; if the import and export goods, articles, or transit or transshipment goods are falsely declared to the customs, a fine may be imposed, and if there is any illegal income, the illegal income shall be confiscated.
5. According to Article 47 of the Regulations on the Administration of the Import and Export of Precursor Chemicals, it is strictly forbidden for any organization or individual to import or export precursor chemicals without permission or beyond the scope of permission, and it is strictly forbidden for individuals to bring into and out of the country precursor chemicals other than pharmaceutical precursor chemicals and potassium permanganate in the first category of precursor chemicals. Individuals who bring into and out of the country pharmaceutical precursor chemicals and potassium permanganate in the first category of precursor chemicals shall be limited to their own use and in reasonable quantities, and shall be subject to customs supervision.
6. Postal, courier and logistics enterprises shall immediately report to the public security organ or customs and cooperate with the public security organ or customs to investigate if they find any illegal mailing, transportation or entrainment of suspected narcotic drugs or psychotropic substances, precursor chemicals or other drug-making raw materials or formulations. Postal, courier and logistics enterprises shall truthfully record or preserve the above information.
7. Those who knowingly sell, transport, or export a non-regulated chemical to the country concerned, knowing that it has been classified as a drug or precursor chemical for control, may face criminal charges or sanctions from the law enforcement authorities of that country.
8. Manufacturers, operators, import and export enterprises and individuals involved in the production, operation, import and export of US-controlled chemicals (see annex for details) should treat orders from relevant countries such as the United States and Mexico with caution, and be vigilant against the risk that exported items are used to manufacture drugs and may face "long-arm jurisdiction" or even "fishing law enforcement".
9. Production, operation, import and export enterprises and individuals of tablet press equipment and molds should treat orders from the United States and Mexico with caution to prevent them from flowing into illegal channels and prevent the risk of being subject to "fishing law enforcement" or sanctions.
10. Relevant enterprises and individuals should enhance their legal awareness, and when exporting non-regulated chemicals and related equipment that have both legitimate uses and can be used for drug production, they should pay close attention to the laws and regulations of relevant importing countries, especially high-risk countries such as the United States and Mexico, and require importing enterprises to perform import legal procedures in accordance with their own laws and regulations to prevent legal risks.
11. If relevant enterprises and individuals find the above-mentioned suspicious orders in foreign trade, they should promptly report to the local public security organ and relevant competent departments to cooperate with the investigation of the facts.
12. In case of illegal infringement by foreign law enforcement departments such as "fishing law enforcement", relevant enterprises and individuals can make full use of legal means to safeguard their own safety and legitimate rights and interests. If they are personally infringed overseas, they can seek consular protection from the diplomatic department through our embassies and consulates abroad.
