[Announcement] Yunnan Provincial Narcotics Control Commission, Notice on Strengthening the Management of Drug-producing Substances

In order to effectively prevent and crack down on illegal and criminal activities of drug production, curb the outflow of drug-producing substances through Yunnan for drug production, and prevent the illegal accumulation of chemicals that cause environmental pollution, this circular is formulated in accordance with the Anti-Drug Law of the People's Republic of China, the Law of the People's Republic of China on Public Security Administration Punishments, the Law of the People's Republic of China on Road Traffic Safety, the Regulations on the Administration of Precursor Chemicals, the Interim Regulations on the Administration of Exporting Precursor Chemicals to Specific Countries (Regions), the Regulations on the Control of Drug Control of Yunnan Province, and the Measures for the Verification and Control of Drug-producing Substances Entering Yunnan of the

First, the toxic substances mentioned in this notice include the following categories:

(1) 38 precursor chemicals in the Regulation on the Administration of Precursor Chemicals (Annex 1).

(2) The other 17 precursor chemicals in the Interim Provisions on the Administration of the Export of Precursor Chemicals to Specific Countries (Regions) (Annex 2).

(III) Other 18 non-regulated chemicals that can be used in the production of drugs (Annex 3).

(4) Reactors, centrifuges, refrigeration compressors, and tablet presses.

Second, the public security organs shall verify and inspect the drug-producing substances entering Yunnan, their uses, and their whereabouts. Before selling or transporting related substances to Yunnan, all relevant enterprises shall submit information on the enterprise, goods, uses, routes, etc. to the local public security organs in a timely manner as required, and the local public security organs shall contact the relevant departments in Yunnan for verification and inspection.

The 38 kinds of precursor chemicals that enter Yunnan without verification and inspection shall be disposed of by the public security organs according to law.

IV. For the other 17 kinds of precursor chemicals, 18 kinds of non-listed chemicals and 4 types of equipment exported to specific countries (regions) that have not been verified and inspected into Yunnan, if their flow direction and legitimate use cannot be proved, they shall be advised to return to the place of delivery; if they do not obey the advice, keep the information of their cargo owners, carriers, customs declarators, etc., and notify the public security organ of the source. If there are situations such as tearing up labels, falsely reporting product names, and concealing entrainment, the public security organ shall investigate and deal with them in accordance with the law in conjunction with the transportation, customs and other departments. If a crime is constituted, criminal responsibility shall be investigated according to law.

Fifth, the county-level public security organs shall take the lead in working with relevant departments to conduct daily inspections of sites within the jurisdiction where chemicals are easily stored, and urge the lessors of rented houses and warehouses to fulfill the lessor's verification obligations. If any chemicals and related suspicious items or substances are found in storage, they shall report to the public security, emergency management and other departments in a timely manner. If the lessor fails to fulfill the verification obligations and causes harmful consequences, he shall be investigated for legal responsibility according to law.

VI. Carriers (logistics, drivers, self-employed households) entrusted with the transportation of narcotic substances shall check the proving materials of the origin of the goods and the transportation license. Those that do not meet the requirements shall not be carried, and shall promptly report to the public security organ.

Public security organs encourage units or citizens to report violations and crimes. Those who retaliate against whistleblowers or condone covering up illegal crimes shall be strictly investigated and punished according to law.
